    Hi all,

    What happens if one party doesn’t turn up to the Family Court or Federal Circuit Court for parenting orders?

    My ex seems to enjoy making things difficult and likely to keep making excuses to delay court hearings or not turn up. Just wondering what happens then? Does the court just make orders without him there?

    He will be fined for wasting court time and will be looked down upon throughout the rest of the proceedings.

    The court gives plenty of options to allow the court to know if people are unable to attend. If he fails complete any of these and doesn’t attend he will be in contempt of court, not good at ALL.

    Thank you for your responses.
    So potentially he could keep making excuses (eg medical reasons etc) and excuse himself from attending court to delay proceedings?

    It will definitely impact him negatively. Not just sure if he will be penalized for it.

    He can make excuses prior to the date and complete a form, however the forms are quite detailed so he will have to have a real excuse that someone can voucher for. Simply not turning up on the day is a big no no and the court case might go ahead without him.
