    Hi all, court coming up and I’ve finally received ex’s paperwork.
    Wow…. it has mostly lies but some of them are blatantly obvious as the court already has proof to the contrary. My question is: what kind of responses/interventions can I expect to be ordered from the magistrate when one party shows blatantly false data? Is it a case conference or what happens? My ex is booked for a mental health assessment but that hasn’t occurred yet, just wondering what courts often do when it’s so obvious that one party is lying to the courts.

    Hi,
    I’m in the same boat at the moment. My ex has filed for parenting orders and several things in the Affidavit can be disproved by actual evidence (i.e. not just my word against his).
    What stage of the Court process are you up to? My ex has diagnosed mental health issues also. Is it a Court ordered mental health assessment for your ex?
    I’m wondering what will happen if and when we get to interim hearing also (the lies should be so clear once the Court compares it to my Affidavit)

    Lies will be ignored by the court and they will look unfavourably on your ex for them.

    Went through this hun. My ex told a lot of lies in court but since we had a lot of back up information including a child mediator and a family report, it was clear they were lies. They just ignored his information and, although it wasn’t said, he was def looked down on for wasting court time.

    It will impact your ex negatively and the court usually does not favor this kind of behavior.

    Surely it is a criminal offence to lie in an affidavit
